Terms of Service

1. Acceptance of Terms

By accessing or using the AutoBuild HQ platform ("Service"), operated by Scalevault LLC, doing business as AutoBuild HQ ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms apply to all users, including organizations, administrators, and any person who accesses or uses the Service.

2. Description of Service

AutoBuild HQ is a marketing automation platform designed for home care, home health, hospice, and related healthcare businesses. The Service includes:

  • AI-powered social media content generation and scheduling
  • Social media account management and publishing (Facebook, Instagram, LinkedIn)
  • Ad performance analysis and copy optimization
  • Content calendar with approval workflows
  • Analytics and reporting
  • Brand management tools

3. Account Registration

  • You must provide accurate, current, and complete information during registration.
  • You are responsible for maintaining the security of your account credentials.
  • You are responsible for all activities that occur under your account.
  • You must notify us immediately of any unauthorized use of your account.
  • You must be at least 18 years old to create an account.

4. Subscription and Billing

  • Free Trial: New accounts receive a 14-day free trial with access to core features.
  • Paid Plans: After the trial, a paid subscription is required for continued access. Plans are billed monthly.
  • Payment: All payments are processed through Stripe. You agree to provide valid payment information.
  • Cancellation: You may cancel your subscription at any time through the billing settings. Access continues until the end of the current billing period.
  • Refunds: Subscription fees are non-refundable, except where required by applicable law.
  • Price Changes: We may change subscription prices with 30 days' notice. Continued use after the price change constitutes acceptance.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation, including HIPAA, FTC guidelines, or advertising regulations
  • Publish false, misleading, or deceptive content
  • Infringe on any third party's intellectual property rights
  • Distribute spam, malware, or harmful content
  • Attempt to gain unauthorized access to the Service or other users' accounts
  • Interfere with or disrupt the Service or its infrastructure
  • Use automated tools to scrape, harvest, or extract data from the Service
  • Publish content that violates the terms of connected social media platforms

6. Content and Intellectual Property

6.1 Your Content

You retain ownership of all content you create, upload, or publish through the Service. By using the Service, you grant us a limited license to process, store, and transmit your content solely to provide the Service.

6.2 AI-Generated Content

Content generated by AI through the Service is provided as suggestions. You are solely responsible for reviewing, editing, and approving all content before it is published. We do not guarantee the accuracy, appropriateness, or compliance of AI-generated content.

6.3 Our Intellectual Property

The Service, including its design, features, code, and documentation, is owned by AutoBuild HQ and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service.

7. Third-Party Integrations

The Service integrates with third-party platforms including Meta (Facebook/Instagram), LinkedIn, Stripe, and AI providers. Your use of these integrations is also subject to the respective third party's terms and policies. We are not responsible for the availability, accuracy, or actions of third-party services.

8. Healthcare Compliance

While the Service includes features designed for healthcare businesses (such as HIPAA content warnings), you are solely responsible for ensuring your marketing content complies with all applicable healthcare regulations, including HIPAA, state licensing requirements, and advertising guidelines. The Service does not provide legal or compliance advice.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCALEVAULT LLC (D/B/A AUTOBUILD HQ) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Indemnification

You agree to indemnify and hold harmless Scalevault LLC (d/b/a AutoBuild HQ), its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising out of your use of the Service, your content, or your violation of these Terms.

12. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason with reasonable notice. Upon termination, your right to use the Service ceases immediately. You may export your data before termination by contacting us.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction.
